I was working as an industrial painter when I suffered a knee injury. At first, I went for my treatment, ultimately had to have several surgeries, and was unable to return to work. My wife finally insisted that I consult with a Workers Compensation Attorney to make sure I received all of the benefits allowed under the law.

Fortunately, they referred me to Tom Stolpman to determine whether I could pursue a “Third Party Case,” seeking damages from the General Contractor on the waste water treatment plant where I was working when the injury occurred.

He carefully reviewed the facts of what happened and the effects of my injury with my wife and me, and advised us to go forward.

The case went forward until a judge granted Summary Judgment against me, and Tom promised to try to get that Order reversed in the appellate court.

His team successfully briefed and argued the appeal, winning a reversal, which allowed my case to go forward.

In 2016, Tom negotiated a six figure settlement of my 3rd Party case, and avoided the effect of a lien by the Workers Compensation Insurance company to recover reimbursement benefits which had been paid for disability and medical benefits.

I was operating a container crane in my work as a Longshoreman when the container suddenly dropped, causing the cab to vibrate intensely–as soon as that happened the container struck other containers while still attached to the spreader bar, and I was again violently thrown about in the operator’s seat.

Within a week or so, I was told that I would need surgery.

My attorney, Robert Nizich, who filed a claim under the Longshore & Harbor Workers Act and referred me to Tom Stolpman to investigate whether someone other than my employer was at fault. He told me about the “Third Party Suits” Tom handled, and I retained him to move forward.

He soon discovered that a spline in the lifting mechanism of the crane had been stripped, and advised me to file a Product Liability case against the manufacturer and installer of the crane.

My medical situation turned out to be complicated–I underwent 8 different surgeries on my back, neck and foot, trying to lessen the pain I was experiencing. Tom was there the whole way, working to develop liability and supporting my wife and me through the most trying time of our lives.

Five years after I was injured, Tom negotiated a settlement of $3,500,000 for me, despite several problems in the case, such a claim that my employer’s mechanics had not properly maintained the crane and claims that I had not been honest with my doctors about previous treatment I had undergone for repetitive back, shoulder and neck issues from operating container cranes.

My feeling is that Tom and his team did a masterful job in my case, and I would refer any of my closest friends and relatives to him if they had a serious injury.
